1. Overview
Arc Boat Company (“Arc”) provides the following express limited warranty on an Arc Sport boat (“Boat”), subject to the remedies, conditions, exclusions, and limitations set forth below.
This warranty applies to Arc Sport boats sold by Arc and registered in the United States or Canada.
2. Limited Warranty and Term
The following coverage begins on the original owner’s date of delivery:
- Structural: A lifetime warranty on the primary structure, including the hull, deck, and hardtop, covering manufacturing defects.
- Gelcoat: A three-year warranty on gelcoat applied at the factory, contingent on you providing proper maintenance and care as described in the Corrosion and Cleaning the Boat section of the Arc Sport Owner’s Manual. This covers blistering, cracking, or spider cracking caused by defective materials or improper application during manufacturing. Damage from environmental factors, improper trailering, misuse, or failure to perform required maintenance is not covered.
- High Voltage Batteries: A five-year warranty on high voltage batteries, guaranteeing a minimum of 80% battery capacity.
- Natural battery capacity loss over time is expected and is not covered. Arc will repair or replace a battery pack that drops below 80% of its original usable capacity during the warranty period. Arc reserves the sole right to determine capacity levels through an authorized service location and will decide whether to repair the unit or provide a replacement of comparable age and performance.
- Motor: A five-year unlimited hours warranty on the motor.
- All Other Arc-Manufactured Components: A five-year warranty on all other Arc-manufactured components for defects in materials or workmanship.
3. Warranty Conditions
3.1. Replacement Parts and Sole Discretion.
Repairs may be completed using new, reconditioned, or remanufactured parts. Arc reserves the exclusive right to decide whether a component will be repaired or replaced. No third party is authorized to create additional warranty obligations on behalf of Arc.
3.2. Your Rights Under State Law.
Warranty coverage varies by part or system and is governed by the applicable section of this guide along with the general provisions below. Arc’s warranties cover defects in materials or workmanship that affect the functionality of the Boat during the warranty period. Given the handcrafted nature of the Boat, minor inconsistencies and variations between individual units are expected and are not covered, nor are issues arising from normal wear and tear. This warranty grants you specific legal rights. You may also have other rights that vary by state. All implied warranties are disclaimed to the fullest extent permitted by applicable law.
4. Exclusions and Limitations
4.1. Warranty Does Not Apply.
The Arc Limited Warranty does not apply in the following circumstances:
- Unauthorized Service: The boat or its components have been repaired in a manner inconsistent with Arc’s official service requirements.
- Abnormal Stress: The boat has been subjected to unusual physical or electrical stress, racing, overloading, accidents, fire, submersion, or negligence during transportation and storage.
- Commercial Use: The vessel is used for commercial purposes. See Section 7 for applicable coverage.
4.2. Damage or Malfunctions Not Covered.
The Arc Limited Warranty does not cover damage or malfunctions caused by:
- Unauthorized Modifications: Installing parts or performing modifications not approved by Arc.
- Neglected Maintenance: Failure to perform routine maintenance as outlined in this Owner’s Manual.
- Delayed Repairs: Failure to seek repairs within 30 calendar days after a concern is identified.
- Improper Charging: Attempting to charge the vessel using methods other than the designated charge port or using unapproved third-party charging adapters.
- Safety Notifications: Failure to comply with field service action or safety recall notifications.
- Improper Handling: Damage resulting from improper towing, winching, trailering, or launching.
- Abuse & Competition: Reckless operation over hazardous areas, racing, or using the vessel for purposes other than its intended design.
- Environmental Damage: Prolonged exposure to salt water (without proper rinsing), extreme weather, lightning, or harmful chemicals and organic growth.
- Storage Conditions: Storing the vessel in temperatures below -31°F without being connected to an active power source/charger.
4.3. Items Not Covered.
This Arc Limited Warranty does not cover any of the following:
- Glass and Acrylic: Scratches, chips, cracks, or breakage to windshields and windows unless caused by a defect in material or workmanship.
- Normal Noise & Vibration: Standard operating sounds, including vibration and harshness, such as pump noise, hull slapping, or general creaks and rattles.
- Third-Party Items: Accessories, components, and systems not manufactured by Arc, including, but not limited to, trailers and external charging equipment, are not covered under this warranty. Such items may be covered by their respective manufacturer’s warranty, and owners are encouraged to contact the applicable manufacturer directly for warranty claims and support. Arc will reasonably assist in identifying the appropriate manufacturer contact and providing any necessary documentation upon request.
- Routine Maintenance: Standard periodic service and diagnostic checks, as well as general exterior and interior care (washing, waxing, and upholstery cleaning).
- Natural Variations: Inherent variations in color or texture of wood trim, gelcoat, or fabric that may change over time due to age or sunlight exposure.
- Cosmetic Damage: Upholstery tears, punctures, or stains, as well as hull scratches, dents, or gouges that occur after the vessel has been delivered.
- Wearable Items: Consumable parts intended to wear out over time, such as sacrificial anodes (zincs), and water pump impellers.
- Towing and Retrieval: Costs associated with towing, hauling out, or salvaging the vessel for non-warranty repairs, including loss of power due to a failure to maintain an adequate battery charge.
4.4. Corrosion and Finish Exclusions.
The Corrosion and Gelcoat Limited Warranty does not cover the following:
- Surface Corrosion: Minor surface oxidation or mineral buildup on the cooling plate, hull hardware, or any underwater components that does not result in perforation or structural failure.
- Post-Sale Repairs: Corrosion or gelcoat issues occurring on surfaces that were repaired, refinished, or replaced after the initial delivery, unless those repairs were performed by an authorized Arc service center under this warranty.
- Abuse or Neglect: Damage to the gelcoat or cooling plate caused by misuse, lack of recommended maintenance, or failure to rinse the vessel after saltwater use.
- Impact Damage: Cracking, chipping, or corrosion in areas where the protective gelcoat or cooling plate finish has been damaged by impact with submerged objects, debris, or trailer bunks.
- Electrolysis and Galvanic Corrosion: Any damage resulting from stray current or electrolysis, specifically including instances where sacrificial anodes (zincs) have been allowed to deplete or are missing entirely.
- Environmental Exposure: Corrosion or finish deterioration caused by prolonged exposure to corrosive chemicals, industrial fallout, or electrolysis resulting from improper mooring or faulty dock wiring.
- Matte or Custom Finishes: Maintaining the appearance of specialized matte or non-standard finishes is the sole responsibility of the owner.
- Aftermarket Treatments: Any damage or accelerated corrosion caused by the application of unapproved aftermarket hull coatings, anti-fouling paints, or supplemental “rustproofing” treatments.
5. Voided Warranty
To maintain your warranty coverage, you must comply with the Owner’s Manual, this Warranty Guide, and any future field service notifications. Your Arc Limited Warranty may be voided if the instructions in these documents, including proper vessel use, maintenance requirements, unapproved software update and service notifications, are not followed.
As the owner, you are responsible for maintaining accurate service records. These should include the service provider’s information, dates of service, detailed descriptions of work performed, and your vessel’s Hull Identification Number (HIN). Arc is not responsible for tracking or transferring these records if the boat is resold.
The following events may also void the warranty:
- Abuse or Neglect: Any misuse that interferes with the proper functioning of the vessel.
- HIN Alteration: Defacing or altering the Hull Identification Number.
- Hour Meter Tampering: Any modifications to, or disconnection of, the hour meter.
- Total Loss: Vessels determined to be dismantled, fire-damaged, submerged (beyond normal operation), salvaged, or declared a total loss.
- Unauthorized Towing: Damage resulting from towing or salvage operations not pre-authorized by Arc Customer Service.
6. Data, Privacy, and International Usage
6.1. Telemetry Data.
Arc reserves the right to use telemetry data obtained directly or remotely to verify vessel or system faults, troubleshoot concerns, conduct research for product improvement, and evaluate performance. This data may be used to analyze incidents and to approve or deny warranty claims.
6.2. International Usage.
If your vessel leaves the United States or Canada:
- Warranty coverage does not apply outside the 50 United States, Washington D.C., or Canada, except where required by law.
- This policy does not apply to vessels registered to U.S. government officials or military personnel on assignment outside of these regions.
6.3. Service and Third-Party Parts.
Having your boat serviced by a non-authorized repair facility or using third-party parts does not automatically void this warranty. However, Arc will not cover defects or damage caused by unauthorized parts or unapproved service. Arc strongly recommends that all maintenance and repairs be performed at an authorized Arc service location.
7. Commercial Use Warranty
For purposes of this warranty, commercial use is defined as, but not limited to, operation of the vessel by ski schools, boat-sharing programs, rental operations, charter services, or any other organization or entity utilizing the vessel for business, or revenue-generating, or for activities of a similar nature.
Vessels operated under commercial use, as defined herein, are subject exclusively to the warranty terms and conditions set forth in this Section 7, and are not eligible for coverage under the standard limited warranty provisions outlined in Section 2.
The following coverage applies to boats used for commercial purposes:
- Structural: A five-year warranty on the primary structure, including the hull, deck, and hardtop, covering manufacturing defects.
- Displays: One-year warranty.
- Foam Flooring and Gelcoat: One-year warranty, contingent on proper maintenance and care as described in the Corrosion and Cleaning the Boat section of the Arc Sport Owner’s Manual. Arc’s warranty will not cover scratching, discoloration, or fading of the gelcoat.
- High Voltage Batteries: One-year warranty.
- Motor: One-year, 200 hour warranty.
- All Other Arc-Manufactured Components: One-year warranty for defects.
After the warranty period expires, the owner is responsible for all labor, materials, and repair costs. Arc’s warranty does not cover incidental or consequential damages related to commercial use of the Boat. Excluded damages include loss of income, loss of time, lost earnings, or other commercial losses resulting from downtime, service, or repair. No compensation will be provided for substitute equipment, business interruption, or other indirect costs incurred while the Boat is out of service for warranty claims. Arc reserves the right to deny warranty claims that, in its sole judgment, result from extraordinary wear and tear associated with commercial operation beyond the stated limits.
8. General Provisions
8.1. General Warranty Exclusions.
Arc’s warranties do not cover:
- Regular maintenance of the Boat or its components.
- Damage to the Boat or its components resulting from owner misuse, lack of or improper maintenance, negligence, or collision.
- Corrosion, marine growth, or paint defects resulting from owner misuse, lack of or improper maintenance, negligence, or collision.
- Modifications made to the Boat by any non-Arc approved third party.
- Theft or vandalism.
- Effects of natural disasters or other unforeseeable acts beyond human control.
- Damage to the Boat resulting from usage in large waves or open ocean conditions, as defined in the Owner’s Manual.
- Harm resulting from overloading the Boat beyond its capacity limits.
- Incidental or consequential damages, including but not limited to loss of use, inconvenience, or transportation costs.
8.2. Warranty Transfer.
These warranties may be transferred a single time only to a second owner, provided that Arc is notified of the transfer via email to service@arcboats.com within 30 calendar days of the ownership change. The new owner will inherit what is remaining of the original warranty.
8.3. Reasonable Time for Repair.
Customer service and satisfaction is a top priority for Arc. However, extenuating circumstances, such as supply chain constraints, may cause delay in time to service or repair your Boat. Please allow reasonable time for completion for repairs and other service. Arc appreciates your patience and is committed to keeping you informed every step of the way.
8.4. Flexible Repair Solutions.
Arc reserves the right to assess and determine the best course of action for repairs, including those that deviate from the original design. Arc will always strive to repair the Boat to functionality consistent with the original condition. Arc reserves the right to determine the extent of repainting or re-gelcoating required to match the original finish. Because gelcoat can naturally fade or change hue over time due to UV exposure, Arc does not guarantee a perfect color match and will not authorize refinishing the entire vessel for the purpose of color blending.
8.5. Limitations and Disclaimers.
This warranty is the only express warranty made in connection with your boat. All other implied or express warranties, including any statutory warranty rights following from local laws, or other conditions, are hereby disclaimed.
9. Owner’s Responsibilities and Procedures
9.1. Owner’s Responsibility.
This warranty is conditioned on the owner’s compliance with the following:
- Owner shall complete and confirm the warranty registration with Arc at delivery.
- Owner shall follow the instructions and operating guidelines in the Owner’s Manual.
- Owner shall follow or comply with the maintenance schedule, operation limits, and lay up instructions, as outlined in the Owner’s Manual.
9.2. Procedure for Enacting Warranty.
You must notify Arc by email at service@arcboats.com within 30 calendar days of discovering a defect. Failure to notify Arc within this period may void coverage for that claim. Prior written authorization from Arc is required for all warranty repairs. Warranty coverage is not effective until Arc confirms the warranty registration.
